Terms and Conditions

1. The carrier and driver, jointly and separately, are authorized to operate and transport the client’s motor vehicle from its pickup location to the designated destination, subject to the terms and conditions of this agreement. The parties acknowledge that while the carrier will make every effort to confirm a driver for the estimated date, no guarantee of pickup or delivery date can be made. Delays may occur due to carrier schedules, mechanical failure, inclement weather, acts of God, or other unforeseen circumstances beyond the control of the carrier and driver. US Shipmate LLC shall not be liable for any charges or liabilities incurred due to the delay of pickup or delivery, including, but not limited to, airline tickets or rental car fees. The client will be provided with the carrier’s schedule at the time of dispatch.

2. The client agrees not to engage any other broker or carrier during the duration of their shipping option. If a client is found to be working with another broker or carrier during this period, they will be subject to a non-refundable deposit fee.

3. Contracted carriers offer door-to-door transport services provided that the truck driver can physically access the pickup and delivery addresses. If access to the pickup or delivery location is restricted by narrow streets, low-hanging trees, or tight turns, the driver may request that the client meet the truck at a nearby large parking lot, such as a grocery store.

4. Carriers are not licensed or insured to transport any personal or household goods. However, we acknowledge that clients may need to load some items into the vehicle. The carrier will not be held liable for any damage caused to the vehicle due to excessive or improper loading of personal items. Clients are only allowed to put personal items in the trunk, and the total weight should not exceed 100 lbs. Exceptions must be discussed and approved by US Shipmate LLC beforehand. Additional fees may be assessed for personal items of any weight. Any misrepresentation of the personal belongings will result in a change of price and/or a dry run fee of $150 if a carrier is required to attend the pick-up scene, and the shipment is different from what was expected. If the carrier is sent out, and the vehicle is not ready as indicated by the shipper, an additional $75.00 rescheduling fee will be charged. US Shipmate LLC must be notified if the shipper is unavailable for pick-up or delivery. The shipper must provide an alternate representative to take their place.

5. Vehicles must be in good running condition and tendered to the carrier with no more than half a tank of fuel. The carrier will not be liable for any damage caused by leaking fluids, freezing, exhaust systems, or antennas that are not properly tied down. Any claim for loss or damage must be noted and signed on the condition report at the time of delivery.

6. Trucking damage and vehicle theft claims fall within the responsibility of carriers only, with coverage from $100,000 up to $250,000 cargo insurance per load, and a minimum of 3/4 of a million dollars public liability and property damage. Any damage or theft incurred to a vehicle during transport is the direct responsibility of the contracted carrier and not of US Shipmate LLC. All carriers will be insured to cover damage caused by the driver or theft during transport. In case of damage, US Shipmate LLC will provide the client with a complete insurance package details for the contracted carrier to file a claim. Clients are required to note and sign all claims at the time of delivery and to submit them in writing within 15 days of delivery to the carriers insurance company.

7. If the shipper fails to have the vehicle ready as indicated, an additional rescheduling fee of $75.00 will be charged. In case the shipper is unavailable for pick up or delivery, an alternate representative must take their place as the shipper, and US Shipmate LLC must be notified. If the vehicle becomes unavailable after an order has been placed, no deposit refund will be issued.

8. The client is required to conduct an inspection report (Bill of Lading/BOL) before releasing or receiving the vehicle(s) from the carrier, regardless of the time of day or the weather conditions. Failure to do so may result in the client’s inability to file a damage claim. Carriers insurance will only process claims for damages due to the carrier’s own negligence. Damage must be reported to US Shipmate LLC within 24 hours of delivery, and must be clearly listed on the BOL and signed by the driver. If there is damage during transport, the client must note those damages on the final inspection report, pay the remaining balance stated on this agreement, and then contact the carrier’s main office as well as the carrier’s insurance company. Failure to note any damage on the final inspection report releases the carrier of any liability and may result in the inability to process a damage claim.

9. Dispatched orders must be canceled by calling the offices of US Shipmate LLC at +1 (925) 353-2832 or sending an email to info@usshipmate.com. Cancellations must be made no less than 24 hours prior to the pick-up date. Cancellations of dispatched orders are subject to a non-refundable $200 fee. The shipper shall be responsible for any fees incurred as a result of a cancellation, and US Shipmate LLC shall not be held liable for any damages arising from such cancellation.

10. A $150.00 non-operational fee will be charged for all non-running vehicles. This fee will be included in the final quote received from US Shipmate LLC. If the vehicle becomes non-operational during transport, this fee will be applied to the original quote. The shipper shall be responsible for any fees incurred as a result of the vehicle becoming non-operational during transport, and US Shipmate LLC shall not be held liable for any damages arising from such non-operational vehicles.

11. US Shipmate LLC agrees to provide a carrier to transport the shipper’s vehicle as promptly as possible in accordance with the shipper’s instructions but cannot guarantee pick-up or delivery on a specified date. A cancellation fee of $200 will be charged for orders canceled 7 days before the requested available pick-up date. US Shipmate LLC does not agree to pay for the rental of a vehicle or be liable for any failure of mechanical or operating parts of the shipper’s vehicle. The shipper warrants that they will pay the price quoted by US Shipmate LLC for delivered vehicles and will not seek to charge back a credit card. This agreement and any shipment hereunder are subject to all terms and conditions of the carrier’s tariff and the uniform straight bill of lading, copies of which are available at the office of the carrier. The shipper shall be responsible for any fees incurred as a result of a cancellation or delay, and US Shipmate LLC shall not be held liable for any damages arising from such cancellation or delay.

12. This agreement shall be governed by and construed in accordance with the laws of the State of North Carolina. The parties further agree that any legal action arising out of this agreement must be filed in a court of jurisdiction, and US Shipmate LLC liability is limited to the amount of money US Shipmate LLC broker’s fee only. The shipper hereby submits to the jurisdiction of such courts and waives any right to jurisdiction in any other location. The shipper hereby agrees to the transport terms provided by US Shipmate LLC. The shipper authorizes a small down payment to be paid to US Shipmate LLC via a credit or debit card or check by phone or mail. The shipper further understands that any remaining balance is due on delivery and that it must be paid in full via cash, cashier’s check, and money order to the authorized transporter.
